The Four Crashes
Friday, September 25 — Warrenton Road. At approximately 9:22 p.m., Deputy Carey responded to a crash after a driver reportedly made an illegal U-turn and struck another vehicle. The driver admitted making the U-turn, acknowledged the crash, and reportedly admitted to drinking earlier that day. Field sobriety tests were administered and a breath sample was obtained. Cameron Biggs, 22, of Spotsylvania, was charged with driving under the influence and held at Rappahannock Regional Jail on a secured bond.
Saturday, September 26 — Eskimo Hill Road. At approximately 2:45 a.m., Deputy Jensen responded to a crash. He was held without bond.
Saturday, September 26 — White Pine Circle. At approximately 11:18 p.m., Deputy Trainor responded to a crash. Authorities reported finding open alcoholic beverages on the passenger seat and floorboard. What These DUI Crashes Could Mean for Injured Victims
Criminal DUI charges and civil injury claims are separate legal matters. If an impaired driver causes a collision that injures another person, the injured party may have grounds to pursue compensation for medical expenses, lost income, pain and suffering, property damage, and other losses, depending on the circumstances.
A DUI arrest or other criminal charge does not automatically establish civil liability or result in compensation for someone involved in the crash. Evidence from the investigation, witness statements, vehicle damage, medical records, and other information may all become relevant when determining how a collision occurred and who may be legally responsible.
Virginia’s contributory negligence rule may also affect an injury claim. If an injured person is found to have been negligent and that negligence contributed to causing the crash, they may be barred from recovering compensation.
